Second, the serious-injury threshold in Insurance Law § 5102(d): you cannot sue for pain and suffering unless the injury fits a statutory category — a fracture, a significant or permanent consequential limitation, significant disfigurement, or a 90/180-day disability.

Which court would my case be in?
Queens injury cases are filed in the civil term of the Queens County Supreme Court, at 88-11 Sutphin Boulevard in Jamaica. (The courthouse our Kew Gardens office faces, on Queens Boulevard, is the criminal term.) If the defendant is the City, the Transit Authority or NYCHA, a Notice of Claim is required within 90 days and a § 50-h hearing may come before any suit.
