Queens has a mix of large private hospitals and City-run facilities, and the distinction is critical: a claim against a public hospital in the NYC Health + Hospitals system requires a Notice of Claim within 90 days and suit within one year and 90 days, instead of the ordinary two and a half years. What the law requires

Malpractice requires proof that the provider departed from accepted medical practice and that the departure caused the injury — both established by a physician in the same specialty, not by the patient's account.

    New York also requires a certificate of merit under CPLR 3012-a before filing, so every case begins with obtaining the complete records and paying for expert review. The deadline is two years and six months from the malpractice or the end of continuous treatment, with extensions under Lavern's Law for missed cancer diagnoses and for injuries to children.

Which court would my case be in?
Queens injury cases are filed in the civil term of the Queens County Supreme Court, at 88-11 Sutphin Boulevard in Jamaica. (The courthouse our Kew Gardens office faces, on Queens Boulevard, is the criminal term.) If the defendant is the City, the Transit Authority or NYCHA, a Notice of Claim is required within 90 days and a § 50-h hearing may come before any suit.
