What you need to know

Rideshare coverage in New York is layered, and the layer that applies depends entirely on what the driver was doing at the moment of the crash. App off: only the driver's personal policy. App on and waiting for a request: a limited contingent policy. On the way to a passenger or with a passenger in the car: the full commercial policy, which in New York reaches $1,250,000 for injuries.
  1. 01

Establishing the phase is a factual question answered by the company's trip data, and that data has to be requested properly and early. Passengers are in the strongest position of all — a passenger is virtually never at fault and can claim against the rideshare policy, the other driver, or both.

  2. 02

Taxis and black cars work differently again.

Yellow medallion taxis in New York City carry their own coverage and are regulated by the TLC; livery and black-car services often operate through the Black Car Fund. Which regime applies changes both who pays and what has to be proved.

What these cases involve

Passengers in an Uber or Lyft

The clearest claim there is — and up to $1.25M of coverage in New York when the app is in an active trip phase.

Struck by a rideshare vehicle

Whether you were driving, cycling or walking, the trip phase decides which policy responds.

Rideshare drivers themselves

Drivers hurt in crashes have both their own coverage questions and a claim against the at-fault driver.

Yellow cabs and TLC vehicles

Separate insurance and separate regulators.

Livery and black car

Black Car Fund coverage may apply to the driver.

App data preservation

The trip record is the proof of the phase. It has to be demanded before it ages out.

Ask us directly
I was a passenger in an Uber that crashed. Who do I sue?
Potentially the Uber driver, the other driver, or both. As a passenger you have no fault to apportion, and the rideshare commercial policy is usually available.
Does no-fault apply to a rideshare trip?
Yes — the vehicle carries no-fault coverage, so your medical bills and part of your wages are covered regardless of fault, on the usual 30-day application deadline.
The driver says the app was off.
That is exactly why the trip data matters, and why it should be demanded early rather than accepted on the driver's word.

If there was more than 5 stars Seth Fields and his associates would get them all. Mr. FIelds went to trial with a jury in Suffolk Cty Riverhead Supreme Ct & won w/ a verdict in minutes for 100% Liability. The defense worked with Mr. FIelds in a settlement before the damages trial began. I would stop here searching any further & contact Seth Fields if you want a Smart, Attainable for your questions, concerns, Empathetic to your needs but a Bull Dog with your case, then you found your attorney.I can’t thank you enough for all your long hours, weekends, holidays that you put into 7 yrs of all my medical, motions, hearings & trial etc. WE WON! You did it and obtained a large settlement that I couldn’t be more happy after this long tough journey. I would refer everyone to you that has a case that needs fighting for. 🙏
