Construction Accident cases in Queens

Long Island City and Astoria have been among the most active construction zones in New York City for a decade, and Flushing, Jamaica and the Rockaways are not far behind. That means high-rise work, façade and scaffold operations under Local Law 11, and interior demolition — the full range of § 240(1) elevation risks.
  1. 01

Queens sites are also where language matters most.

Much of the work is done by immigrant crews, and workers are frequently told, wrongly, that they have no claim because of their immigration status or because they are paid off the books. New York courts have held otherwise: the Labor Law protects the worker on the site.

What the law requires

New York gives construction workers protections no other worker has.
  1. 01

    Labor Law § 240(1) —

the Scaffold Law — imposes absolute liability on owners and general contractors for elevation-related injuries: falls from scaffolds, ladders and platforms, and objects that fall from above. Comparative fault does not reduce that recovery.

  2. 02

Labor Law § 241(6) requires a violation of a specific Industrial Code provision, and pleading it generally rather than specifically is one of the most common ways these cases are lost. Both claims sit on top of workers' compensation, which pays treatment and part of your wages but nothing for pain and suffering.

Questions about construction accident cases in Queens

Not answered here? A lawyer will answer it, free and at any hour.

Ask us directly
Which court would my case be in?
Queens injury cases are filed in the civil term of the Queens County Supreme Court, at 88-11 Sutphin Boulevard in Jamaica. (The courthouse our Kew Gardens office faces, on Queens Boulevard, is the criminal term.) If the defendant is the City, the Transit Authority or NYCHA, a Notice of Claim is required within 90 days and a § 50-h hearing may come before any suit.
What does it cost to hire you?
Nothing up front. The consultation is free and the fee comes out of the recovery. If there is no recovery, you owe no attorney fee.
How soon should I call?
As soon as you can. Deadlines aside, the evidence in these cases has a short life — camera footage is overwritten, vehicles are repaired, sites are cleaned up and records age out. Early work is what makes the difference.

If there was more than 5 stars Seth Fields and his associates would get them all. Mr. FIelds went to trial with a jury in Suffolk Cty Riverhead Supreme Ct & won w/ a verdict in minutes for 100% Liability. The defense worked with Mr. FIelds in a settlement before the damages trial began. I would stop here searching any further & contact Seth Fields if you want a Smart, Attainable for your questions, concerns, Empathetic to your needs but a Bull Dog with your case, then you found your attorney.I can’t thank you enough for all your long hours, weekends, holidays that you put into 7 yrs of all my medical, motions, hearings & trial etc. WE WON! You did it and obtained a large settlement that I couldn’t be more happy after this long tough journey. I would refer everyone to you that has a case that needs fighting for. 🙏
