Truck Accident cases in Queens

Queens carries freight the way no other borough does. The Van Wyck and the Grand Central feed two airports, the LIE runs the length of the borough, and the industrial blocks of Long Island City, Maspeth and Jamaica hold the truck yards and distribution buildings that supply the rest of the city. Air cargo out of JFK adds a category of its own: container haulers running between the airport and warehouses on local streets that were never built for them.

These cases are federal as much as they are local.

An interstate carrier keeps driver logs, ELD records, inspection and maintenance files and engine data, all on retention schedules, and its insurer usually has an investigator at the scene the same day. Where the truck belonged to the City, the Sanitation Department or a transit authority, the 90-day Notice of Claim applies on top.

What the law requires

A commercial carrier leaves a paper trail an ordinary driver does not: hours-of-service and electronic logging data, driver qualification files, inspection and maintenance records, dispatch documents, and the engine control module that recorded speed and braking before impact.

All of it has a retention period, some of it measured in months, which is why the first step in a truck case is a spoliation letter demanding preservation. The carrier is liable for its driver and often independently liable for hiring, training or scheduling — and federal minimum coverage for an interstate carrier starts at $750,000.

Questions about truck accident cases in Queens

Ask us directly
Which court would my case be in?
Queens injury cases are filed in the civil term of the Queens County Supreme Court, at 88-11 Sutphin Boulevard in Jamaica. (The courthouse our Kew Gardens office faces, on Queens Boulevard, is the criminal term.) If the defendant is the City, the Transit Authority or NYCHA, a Notice of Claim is required within 90 days and a § 50-h hearing may come before any suit.
What does it cost to hire you?
Nothing up front. The consultation is free and the fee comes out of the recovery. If there is no recovery, you owe no attorney fee.
How soon should I call?
As soon as you can. Deadlines aside, the evidence in these cases has a short life — camera footage is overwritten, vehicles are repaired, sites are cleaned up and records age out. Early work is what makes the difference.

If there was more than 5 stars Seth Fields and his associates would get them all. Mr. FIelds went to trial with a jury in Suffolk Cty Riverhead Supreme Ct & won w/ a verdict in minutes for 100% Liability. The defense worked with Mr. FIelds in a settlement before the damages trial began. I would stop here searching any further & contact Seth Fields if you want a Smart, Attainable for your questions, concerns, Empathetic to your needs but a Bull Dog with your case, then you found your attorney.I can’t thank you enough for all your long hours, weekends, holidays that you put into 7 yrs of all my medical, motions, hearings & trial etc. WE WON! You did it and obtained a large settlement that I couldn’t be more happy after this long tough journey. I would refer everyone to you that has a case that needs fighting for. 🙏
