Construction Accident cases in Nassau County

Nassau construction is school and municipal work, hospital expansion, transit-oriented development around the LIRR stations, and a large volume of residential building and renovation. The falls come off extension ladders and baker's scaffolds on small residential jobs as often as off structural steel, and Labor Law § 240(1) applies to both — the height does not have to be dramatic for the statute to attach.
  1. 01

What is different here is the ownership.

A job for a school district, a village or the county puts a public entity in the case, which can bring a 90-day Notice of Claim alongside the Labor Law claim. And on small Island jobs the general contractor is often a local company with modest coverage, so identifying the owner and every subcontractor early is what decides whether there is enough insurance behind the claim.

What the law requires

New York gives construction workers protections no other worker has.
  1. 01

    Labor Law § 240(1) —

the Scaffold Law — imposes absolute liability on owners and general contractors for elevation-related injuries: falls from scaffolds, ladders and platforms, and objects that fall from above. Comparative fault does not reduce that recovery.

  2. 02

Labor Law § 241(6) requires a violation of a specific Industrial Code provision, and pleading it generally rather than specifically is one of the most common ways these cases are lost. Both claims sit on top of workers' compensation, which pays treatment and part of your wages but nothing for pain and suffering.

Ask us directly
Which court would my case be in?
Nassau County cases are filed in the Supreme Court at 100 Supreme Court Drive, Mineola — minutes from our Hicksville office. Claims against the County, a town, a village, a school district, NUMC or NICE bus require a Notice of Claim within 90 days.
What does it cost to hire you?
Nothing up front. The consultation is free and the fee comes out of the recovery. If there is no recovery, you owe no attorney fee.
How soon should I call?
As soon as you can. Deadlines aside, the evidence in these cases has a short life — camera footage is overwritten, vehicles are repaired, sites are cleaned up and records age out. Early work is what makes the difference.

If there was more than 5 stars Seth Fields and his associates would get them all. Mr. FIelds went to trial with a jury in Suffolk Cty Riverhead Supreme Ct & won w/ a verdict in minutes for 100% Liability. The defense worked with Mr. FIelds in a settlement before the damages trial began. I would stop here searching any further & contact Seth Fields if you want a Smart, Attainable for your questions, concerns, Empathetic to your needs but a Bull Dog with your case, then you found your attorney.I can’t thank you enough for all your long hours, weekends, holidays that you put into 7 yrs of all my medical, motions, hearings & trial etc. WE WON! You did it and obtained a large settlement that I couldn’t be more happy after this long tough journey. I would refer everyone to you that has a case that needs fighting for. 🙏
