Nassau has both large private hospital systems and the Nassau University Medical Center in East Meadow, which is a public benefit corporation — and that changes the deadline entirely. A malpractice claim against NUMC normally requires a Notice of Claim within 90 days and suit within one year and 90 days, rather than the two years and six months that applies to a private hospital. Patients almost never know this distinction exists.

Malpractice requires proof that the provider departed from accepted medical practice and that the departure caused the injury — both established by a physician in the same specialty, not by the patient's account.

    New York also requires a certificate of merit under CPLR 3012-a before filing, so every case begins with obtaining the complete records and paying for expert review. The deadline is two years and six months from the malpractice or the end of continuous treatment, with extensions under Lavern's Law for missed cancer diagnoses and for injuries to children.
