The city has both the largest concentration of private academic medical centres in the country and the NYC Health + Hospitals public system, and the difference decides the deadline: a claim against a public hospital normally requires a Notice of Claim within 90 days and suit within one year and 90 days, instead of two years and six months. Patients treated at a public facility are frequently unaware of this until it is too late, which is why the first call should not wait for the records to arrive.

What the law requires

Malpractice requires proof that the provider departed from accepted medical practice and that the departure caused the injury — both established by a physician in the same specialty, not by the patient's account.

    New York also requires a certificate of merit under CPLR 3012-a before filing, so every case begins with obtaining the complete records and paying for expert review. The deadline is two years and six months from the malpractice or the end of continuous treatment, with extensions under Lavern's Law for missed cancer diagnoses and for injuries to children.

    Against a public hospital, a 90-day Notice of Claim applies as well.

Which court would my case be in?
A city case is filed in the Supreme Court of the county where it arose — Queens in Jamaica, Kings at 360 Adams Street, Bronx at 851 Grand Concourse, New York County at 60 Centre Street, Richmond in St. George. If the defendant is the City, the MTA, the Transit Authority, NYCHA or a public hospital, a Notice of Claim is due within 90 days.
