Nursing Home Abuse cases in The Bronx

The Bronx has one of the densest concentrations of skilled nursing and rehabilitation facilities in the state, run by a mix of private operators, hospital systems and public entities — and who owns the home decides both the defendant and the deadline. A publicly operated facility brings the shorter public-entity clocks with it, which is the first thing we check.

New York does not require a family to frame these cases as ordinary negligence.

Public Health Law § 2801-d lets a resident sue for the deprivation of a right or benefit created by statute or regulation — staffing levels, hygiene, supervision, care planning — and allows attorney fees on top of damages. The proof is documentary: care plans against what was actually done, turning and wound-care charts, fall-risk assessments, weight and hydration logs, incident reports and staffing sheets. Pressure ulcers, repeated falls, unexplained fractures, dehydration and medication errors are what these records tend to show.

What the law requires

New York gives nursing home residents a private right of action that most injured people do not have. Public Health Law § 2801-d lets a resident sue a facility for depriving them of a right or benefit created by statute or regulation — the staffing, hygiene, supervision and care-planning standards — without having to frame the case as ordinary negligence, and it allows attorney fees on top of damages.
  1. 01

The federal and state regulations themselves become the standard of care.

  2. 02

What proves these cases is the record:

the care plan and whether it was followed, the wound-care and turning charts, fall-risk assessments, incident reports, weight logs and the facility's staffing sheets. Pressure ulcers, repeated falls, dehydration, malnutrition, unexplained fractures and medication errors are the recurring patterns. Where the facility is publicly operated, the shorter public-entity deadlines apply, so the first question is always who owns the home.

Which court would my case be in?
Bronx cases are filed in the Bronx County Supreme Court at 851 Grand Concourse. Claims against the City, NYCHA, the Transit Authority or a public hospital require a Notice of Claim within 90 days.
What does it cost to hire you?
Nothing up front. The consultation is free and the fee comes out of the recovery. If there is no recovery, you owe no attorney fee.

If there was more than 5 stars Seth Fields and his associates would get them all. Mr. FIelds went to trial with a jury in Suffolk Cty Riverhead Supreme Ct & won w/ a verdict in minutes for 100% Liability. The defense worked with Mr. FIelds in a settlement before the damages trial began. I would stop here searching any further & contact Seth Fields if you want a Smart, Attainable for your questions, concerns, Empathetic to your needs but a Bull Dog with your case, then you found your attorney.I can’t thank you enough for all your long hours, weekends, holidays that you put into 7 yrs of all my medical, motions, hearings & trial etc. WE WON! You did it and obtained a large settlement that I couldn’t be more happy after this long tough journey. I would refer everyone to you that has a case that needs fighting for. 🙏
