Product Liability cases in Long Island

Long Island product cases arrive from the trades and from the garage: table saws and nail guns without functioning guards, ladders and scaffolds that failed under load, snow blowers and lawn equipment, e-bike and scooter batteries that ignited while charging, and machinery on the shop floors of the Island's light-industrial parks.
  1. 01

A workplace injury from a defective machine is one of the clearest examples of a third-party claim running alongside a workers' compensation file.

  2. 02

The single most important thing a client can do is keep the product.

Do not return it to the retailer, do not let the employer send it back to the manufacturer for inspection, and do not have it repaired. The item itself, with its packaging, manual and serial number, is the case.

What the law requires

New York allows three routes against the maker or seller of a product that injured someone: a manufacturing defect, where the item left the line different from its design; a design defect, where the product as designed was not reasonably safe and a safer alternative was feasible; and a failure to warn of a danger the maker knew or should have known about.

The deadline to know

The clock is three years from the injury, and a wrongful death claim from a defective product runs on its own two-year period from the date of death.

01

Liability runs down the whole chain of distribution —

manufacturer, distributor and retailer — so a claim does not fail because an importer is unreachable.

02

These cases live or die on the product itself.

Do not return it, repair it or throw it out: the item, its packaging, the manual and the receipt are the evidence, and the same duty to preserve runs against the other side once they are on notice.

Verdicts and settlements

Verdict for wrongful death, against landlord, caused by fire that spread through apartment that was without smoke detectors.

  • $1,105,000

  • $350,000

For client who sustained partial amputation of his foot after having stepped into path of a lawnmower.

Questions about product liability cases in Long Island

Not answered here? A lawyer will answer it, free and at any hour.

Ask us directly
Which court would my case be in?
Nassau County cases are filed in the Supreme Court at 100 Supreme Court Drive, Mineola; Suffolk County cases go to 1 Court Street, Riverhead. Which one depends on where the accident happened and where the parties are — we handle the appearances either way.
What does it cost to hire you?
Nothing up front. The consultation is free and the fee comes out of the recovery. If there is no recovery, you owe no attorney fee.
How soon should I call?
As soon as you can. Deadlines aside, the evidence in these cases has a short life — camera footage is overwritten, vehicles are repaired, sites are cleaned up and records age out. Early work is what makes the difference.

If there was more than 5 stars Seth Fields and his associates would get them all. Mr. FIelds went to trial with a jury in Suffolk Cty Riverhead Supreme Ct & won w/ a verdict in minutes for 100% Liability. The defense worked with Mr. FIelds in a settlement before the damages trial began. I would stop here searching any further & contact Seth Fields if you want a Smart, Attainable for your questions, concerns, Empathetic to your needs but a Bull Dog with your case, then you found your attorney.I can’t thank you enough for all your long hours, weekends, holidays that you put into 7 yrs of all my medical, motions, hearings & trial etc. WE WON! You did it and obtained a large settlement that I couldn’t be more happy after this long tough journey. I would refer everyone to you that has a case that needs fighting for. 🙏

The most amazing, professional and knowledgeable with great communicators with injury law, and I highly recommend that there is no reason for second and third opinions on procuring a law firm with their experience and know how. They are second to none. My time was precious, and they respected every minute of it. Thank you!
