Car accidents in Garden City

Garden City's car cases come from a handful of very busy roads. Old Country Road and Stewart Avenue carry the traffic for Roosevelt Field and the office buildings around it; Franklin Avenue and Seventh Street carry the village's own retail traffic; and the Meadowbrook Parkway runs just to the east.
  1. 01

The recurring crashes are rear-end collisions in the stop-and-go traffic on Old Country Road, turning collisions at the mall entrances and the office driveways on Stewart Avenue, and low-speed collisions in the parking fields themselves, which are private property but still fully covered by no-fault.

  2. 02

A parking-lot crash is not a minor case because the speed was low.

Soft-tissue and spinal injuries from low-speed rear-end impacts are common, and the insurer's first argument in those cases is usually that the damage to the car was too slight to cause them. The medical record from the first weeks is what answers that.

Who the claim may be against — and the deadline that comes with it

Roosevelt Field and much of the retail and office strip east of the village are in East Garden City, an unincorporated part of the Town of Hempstead, even though the mailing address reads "Garden City".
  1. 01

The Incorporated Village of Garden City is a separate municipality with its own police department and its own street maintenance.

So a crash with a Garden City address might involve a village road, a Town of Hempstead road, a Nassau County road, a State parkway or private property — and each of those leads to a different defendant and a different deadline:

    • The village, the town, the county or a school district: a Notice of Claim under General Municipal Law § 50-e, normally within 90 days, with suit within one year and 90 days. Claims based on a road defect usually also require proof that the municipality had prior written notice of it.
    • The Meadowbrook Parkway is a State parkway; a claim against the State goes to the Court of Claims, not to Mineola, on its own short timetable.
    • A mall owner, a store or a private driver: generally three years, in the Nassau County Supreme Court in Mineola. A collision caused by the layout, signage or maintenance of a parking field can bring in the property owner and its maintenance contractor as well as the other driver.

What New York law requires

This is general information about how New York car claims work, not advice about yours.
  1. 01

No-fault comes first. New York no-fault coverage pays medical bills and part of lost wages regardless of who caused the crash, up to the $50,000 basic limit. The NF-2 application has to reach the insurer within 30 days of the accident, and medical bills within 45 days of treatment. Missing those dates is the most common reason no-fault benefits are denied.

  2. 02

Then the serious-injury threshold. Insurance Law § 5102(d) allows a claim against the at-fault driver for pain and suffering only where the injury falls into one of the statutory categories — among them a fracture, significant disfigurement, a permanent loss of use, a permanent consequential or significant limitation of use of a body organ, member, function or system, or an injury that prevented you from performing substantially all of your usual daily activities for 90 of the first 180 days. Economic loss above the no-fault limit can be claimed without meeting the threshold. Whether an injury qualifies is decided on the medical evidence, which is why consistent treatment and documentation in the first weeks carry so much weight.

The first weeks

What usually matters most early on

  • A police report, and the DMV MV-104 report that drivers must file within 10 days when anyone is injured
  • The NF-2 no-fault application, which must reach the insurer within 30 days
  • Medical treatment that starts promptly and is documented consistently
  • Photographs of the vehicles, the scene and the injuries, and the names of witnesses
  • Any camera footage nearby — it is usually overwritten within weeks
  • A Notice of Claim within 90 days if a public vehicle or a public road is involved

Ask us directly
The crash happened in the Roosevelt Field parking lot. Does no-fault still apply?
Yes. No-fault applies to injuries arising from the use of a motor vehicle, on a public road or in a private lot. The NF-2 application still has to reach the insurer within 30 days. The mall and its security staff may also have camera footage of the lot, which is overwritten on a schedule, so it is worth asking for early.
My address says Garden City. Is the village the defendant?
Not necessarily. Roosevelt Field and the area around it are in unincorporated East Garden City, part of the Town of Hempstead. Whose road it was — village, town, county, State or private — decides who receives the Notice of Claim, and that is something we confirm before anything is filed.
The other driver's insurer called me. Should I give a statement?
Not before speaking to a lawyer. Adjusters are trained to ask questions whose answers narrow a claim later, especially on how you felt immediately after a low-speed crash.
Where would my case be heard?
A claim against a private driver or business is filed in the Nassau County Supreme Court, 100 Supreme Court Drive in Mineola. A claim against the State goes to the Court of Claims.
What does it cost to hire you?
Nothing up front. The consultation is free and the fee comes out of the recovery. If there is no recovery, you owe no attorney fee.

If there was more than 5 stars Seth Fields and his associates would get them all. Mr. FIelds went to trial with a jury in Suffolk Cty Riverhead Supreme Ct & won w/ a verdict in minutes for 100% Liability. The defense worked with Mr. FIelds in a settlement before the damages trial began. I would stop here searching any further & contact Seth Fields if you want a Smart, Attainable for your questions, concerns, Empathetic to your needs but a Bull Dog with your case, then you found your attorney.I can’t thank you enough for all your long hours, weekends, holidays that you put into 7 yrs of all my medical, motions, hearings & trial etc. WE WON! You did it and obtained a large settlement that I couldn’t be more happy after this long tough journey. I would refer everyone to you that has a case that needs fighting for. 🙏
