What you need to know

A traumatic brain injury frequently produces a normal CT scan. The client goes home, and then cannot hold a conversation, cannot tolerate light, loses their temper, cannot do the job they did for twenty years. Proving that injury takes neuropsychological testing, treating-provider testimony and — often most persuasively — the testimony of people who knew the person before.
  1. 01

    Spinal injuries divide sharply.

A cord injury causing paralysis is catastrophic and obvious. A herniated disc is neither, and it is the most litigated injury in New York personal injury practice: the defense will point to degenerative changes on the MRI and argue the disc was already there. The response is the clinical history, the correlation of findings to symptoms, and the treating surgeon's opinion on causation.

  2. 02

These are also the cases where the life-care side of the claim matters most: future surgery, attendant care, home modification, assistive equipment, and lost earning capacity over a working life. Building that record properly is what separates a settlement that runs out from one that does not.

Several of this firm's largest published results are brain and spine cases, including $4,400,000 for spinal injuries requiring surgery, $4,000,000 for a driver who sustained a brain injury, $3,000,000 for a post-traumatic brain injury, and $1,000,000 for a spinal cord injury from a staircase fall.

What these cases involve

Traumatic brain injury

From concussion to severe TBI, including injuries with normal imaging.

Post-concussion syndrome

Headache, memory and mood changes that persist long after "mild" was written in the chart.

Herniated and bulging discs

Cervical and lumbar, surgical and non-surgical — both compensable.

Spinal cord injury and paralysis

Cases where the life-care plan is the centre of the claim.

Serious-injury threshold

In motor vehicle cases, how these injuries are documented decides whether you may sue at all.

Future care and lost earnings

Proved with medical, vocational and economic experts.

Verdicts and settlements

Recoveries obtained by this firm

  • $7,500,000

Verdict for wrongful death, against landlord, caused by fire that spread through apartment that was without smoke detectors.

  • $3,000,000

Banquet guest struck in the head by a server holding a tray of food causing him to sustain a post-traumatic brain injury.

  • $965,000

For a young man that was on the hood of a car which accelerated causing a fall from the vehicle and a brain injury.

Prior results do not guarantee a similar outcome. Every case is different, and the result in any case depends on its own facts.

My CT scan was normal but I am not myself.
That is common with a traumatic brain injury and it does not mean nothing happened. Neuropsychological testing and the accounts of people who knew you before are the evidence that matters.
The insurer says my herniated disc is degenerative.
They almost always do. What answers it is the clinical picture before and after the accident, the correlation between the imaging and your symptoms, and your treating surgeon's causation opinion.
Does a non-surgical disc still count?
Yes. This firm obtained a $1,200,000 verdict against the New York City Transit Authority for a client with a herniated disc that did not require surgery.

If there was more than 5 stars Seth Fields and his associates would get them all. Mr. FIelds went to trial with a jury in Suffolk Cty Riverhead Supreme Ct & won w/ a verdict in minutes for 100% Liability. The defense worked with Mr. FIelds in a settlement before the damages trial began. I would stop here searching any further & contact Seth Fields if you want a Smart, Attainable for your questions, concerns, Empathetic to your needs but a Bull Dog with your case, then you found your attorney.I can’t thank you enough for all your long hours, weekends, holidays that you put into 7 yrs of all my medical, motions, hearings & trial etc. WE WON! You did it and obtained a large settlement that I couldn’t be more happy after this long tough journey. I would refer everyone to you that has a case that needs fighting for. 🙏
