Work injuries in New York City

New York City work injuries arrive from construction, building services and cleaning, restaurants and hotels, healthcare and home care, warehousing, and the delivery and app-based courier economy that now moves a large share of the city on two wheels.
  1. 01

The comp claim is filed with the Workers' Compensation Board, and it pays for medical treatment and a portion of lost wages — but nothing at all for pain and suffering, and nothing beyond the schedule for a permanent injury.

  2. 02

The case that changes a worker's outcome is usually the one against somebody other than the employer:

the owner and general contractor on a construction site under Labor Law §§ 240 and 241(6), the driver who hit the work van, the building owner whose stairwell gave way, the manufacturer of an unguarded machine. Those third-party claims run alongside the comp file, and the carrier's lien on the recovery under WCL § 29 is negotiable. Two points come up constantly in this city and are worth stating plainly: immigration status does not bar a workplace injury claim in New York, and a courier or driver labelled an independent contractor may still be an employee in law — how the work was actually controlled decides it, not the label on the paperwork.

What the law requires

Workers' compensation covers medical treatment and part of your lost wages regardless of who was at fault, and in exchange you generally cannot sue your employer.
  1. 01

Notice to the employer should be given within 30 days and the C-3 filed within two years.

What most injured workers are never told is the third-party claim: if anyone other than your employer contributed — a site owner or general contractor, another trade's subcontractor, the driver who hit your work vehicle, the maker of the machine — that is a separate lawsuit for pain and suffering, which comp does not pay at all.

Verdicts and settlements

Recoveries obtained by this firm

  • $7,500,000

Verdict for wrongful death, against landlord, caused by fire that spread through apartment that was without smoke detectors.

  • $2,800,000

For a truck driver who twisted his back loading a truck causing lumbar herniated disc which required surgery.

  • $150,000

Verdict obtained in favor of a warehouse worker who was struck by a hi-low vehicle. Case was appealed by defendant twice, both being unsuccessful, including a verdict which was overturned by the trial judge being reinstated by the Appellate Division.

Questions about workers' compensation cases in New York City

Not answered here? A lawyer will answer it, free and at any hour.

Ask us directly
Which court would my case be in?
A city case is filed in the Supreme Court of the county where it arose — Queens in Jamaica, Kings at 360 Adams Street, Bronx at 851 Grand Concourse, New York County at 60 Centre Street, Richmond in St. George. If the defendant is the City, the MTA, the Transit Authority, NYCHA or a public hospital, a Notice of Claim is due within 90 days.
What does it cost to hire you?
Nothing up front. The consultation is free and the fee comes out of the recovery. If there is no recovery, you owe no attorney fee.
How soon should I call?
As soon as you can. Deadlines aside, the evidence in these cases has a short life — camera footage is overwritten, vehicles are repaired, sites are cleaned up and records age out. Early work is what makes the difference.

If there was more than 5 stars Seth Fields and his associates would get them all. Mr. FIelds went to trial with a jury in Suffolk Cty Riverhead Supreme Ct & won w/ a verdict in minutes for 100% Liability. The defense worked with Mr. FIelds in a settlement before the damages trial began. I would stop here searching any further & contact Seth Fields if you want a Smart, Attainable for your questions, concerns, Empathetic to your needs but a Bull Dog with your case, then you found your attorney.I can’t thank you enough for all your long hours, weekends, holidays that you put into 7 yrs of all my medical, motions, hearings & trial etc. WE WON! You did it and obtained a large settlement that I couldn’t be more happy after this long tough journey. I would refer everyone to you that has a case that needs fighting for. 🙏

The most amazing, professional and knowledgeable with great communicators with injury law, and I highly recommend that there is no reason for second and third opinions on procuring a law firm with their experience and know how. They are second to none. My time was precious, and they respected every minute of it. Thank you!
