What the law requires

Every New York car case runs through the same two gates.

    First, no-fault:

    your own insurer pays medical bills and part of your lost wages regardless of fault, but the application has to reach them within 30 days and the bills within 45 days of treatment. Second, the serious-injury threshold in Insurance Law § 5102(d): you cannot sue for pain and suffering unless the injury fits a statutory category — a fracture, a significant or permanent consequential limitation, significant disfigurement, or a 90/180-day disability.

    Insurers litigate that threshold hard, which is why the medical documentation from the first month matters as much as the police report.

Which court would my case be in?
A city case is filed in the Supreme Court of the county where it arose — Queens in Jamaica, Kings at 360 Adams Street, Bronx at 851 Grand Concourse, New York County at 60 Centre Street, Richmond in St. George. If the defendant is the City, the MTA, the Transit Authority, NYCHA or a public hospital, a Notice of Claim is due within 90 days.
